    General Terms and Conditions (GTC)

    § 1 Scope

    1.1 These General Terms and Conditions (GTC) apply to all contracts for the temporary
    rental of holiday apartments under the trade name «Wohnungen an der Uniklinik» /
    «Apartments an der Uniklinik» (hereinafter «Landlord») to the guest (hereinafter
    «Tenant»).

    1.2 Deviating terms of the Tenant shall not become part of the contract unless
    expressly accepted in writing by the Landlord.


    § 2 Conclusion of contract

    2.1 The contract becomes effective once the apartment is confirmed by the Landlord —
    either directly via rentapartment-freiburg.com or via a third-party platform (e.g.
    Booking.com, Airbnb).

    2.2 The contracting parties are the Landlord and the Tenant. The Tenant is liable for
    all additional persons travelling with them.


    § 3 Prices and payment

    3.1 The agreed nightly price is shown in the confirmation document and includes
    statutory VAT.

    3.2 The Freiburg city overnight tax (Kurtaxe), currently 5 % under the applicable
    municipal regulations, is already included in the agreed nightly price and is not
    charged separately. Should the city of Freiburg adjust the statutory tax rate in
    the future, the applicable rate shall continue to be included in the nightly price.

    3.3 Payment is made either in advance through the booking platform or by separate
    bank invoice.


    § 4 Arrival and self check-in (key safe)

    4.1 The apartments offer contactless self check-in. The Tenant receives the
    individual code and location instructions for the key safe in good time before
    arrival.

    4.2 Standard check-in is from 3:00 p.m., check-out by 11:00 a.m. Flexible times can
    be arranged subject to availability.

    4.3 The Landlord is generally not personally present at check-in. No keys are handed
    over face-to-face and no paper forms are filled in at a reception desk; data required
    for the official guest registration are collected during booking via the respective
    platform.

    4.4 Key return and loss:

    (a) The Tenant must keep the received code confidential and return the key to the
    agreed location inside the apartment upon departure.

    (b) In case of loss or non-return of the key, the Tenant shall bear the cost of
    producing a replacement key.

    (c) The Landlord is not obliged to replace the master lock or all locks in the
    building upon every key loss.

    (d) In the event of a criminal offence (e.g. break-in, theft) potentially
    connected with a lost or unreturned key, the Landlord expressly reserves the
    right to transmit the Tenant's personal data to the competent law-enforcement
    authorities.


    § 5 Tenant obligations and use

    5.1 The Tenant undertakes to treat the apartment and its furnishings with care.
    Because check-in is performed by the Tenant alone without involvement of the
    Landlord, the following additional rules apply:

    (a) The Tenant shall inspect the condition of the apartment immediately upon
    arrival. Any existing damage, defects or missing items must be reported to the
    Landlord in writing (email is sufficient) within 24 hours after arrival.

    (b) If no notice of defects is given within this period, the apartment is deemed
    to have been accepted in proper and contractual condition.

    (c) Damage or contamination identified at check-out by the Landlord's cleaning
    staff shall be fully reimbursed by the Tenant in accordance with § 280 of the
    German Civil Code (BGB).

    (d) In case of dispute, photographic documentation of the apartment's condition
    during final cleaning shall serve as evidence.

    5.2 The number of persons using the apartment must not exceed the maximum agreed in
    the booking.

    5.3 Sub-letting and forwarding of access information to third parties are not
    permitted.

    5.4 Smoking is prohibited inside the apartments and throughout the building.

    5.5 Pets are allowed only with prior written consent of the Landlord.

    5.6 Noise and disturbance, especially between 10:00 p.m. and 7:00 a.m., must be
    avoided.


    § 6 Parking

    6.1 If agreed in the booking document, the Landlord provides the Tenant with an
    unguarded outdoor parking space in front of the building. The corresponding fee is
    either included in the nightly price or charged separately.

    6.2 Access to the parking space is via a retractable barrier (bollard / barrier
    post). The Tenant receives the corresponding key to operate the barrier from the
    key safe.

    6.3 The parking space is located in a publicly accessible area in front of the
    building. The Landlord assumes no liability whatsoever for damage, vandalism or
    theft to the parked vehicle or its contents.

    6.4 In case of loss or non-return of the parking-barrier key, the Tenant shall bear
    the cost of obtaining a replacement. The key must be returned together with the
    apartment key to the agreed location inside the apartment upon departure.

    6.5 In case of unauthorised parking by third parties on the Tenant's parking space
    or unauthorised use of the parking facility without payment, the Landlord expressly
    reserves the right to have the unauthorised vehicle towed to a holding lot at the
    expense of the unauthorised user.


    § 7 Waste and waste separation

    7.1 The Tenant receives two keys:

    (a) Master key for the apartment and the building entrance;

    (b) Small key for the black general-waste bin (Restmüll).

    7.2 Waste separation follows the rules of the Freiburg waste-management authority
    and the building management and is divided into four streams:

    (a) ⚫ Black bin — general waste (Restmüll);
    (b) 🟢 Green bin — paper and cardboard;
    (c) 🟤 Brown bin — bio-waste. Bio-waste may only be disposed of in biodegradable
    paper bags or compostable bio-bags; the use of ordinary plastic or cellophane
    bags is expressly prohibited;
    (d) 🟡 Yellow recycling sacks — plastic, aluminium, composite packaging and other
    recyclable materials. Yellow sacks are to be placed in the designated area at
    the rear of the building (in particular during longer stays).

    7.3 The Tenant is obliged to separate waste correctly. Should the Landlord incur
    fines, surcharges, penalties or notices of warning from the city of Freiburg, the
    building management, the waste-disposal contractor or any other third party as a
    result of the Tenant's incorrect waste separation, the Tenant is obliged to
    reimburse such amounts in full pursuant to § 280 BGB.


    § 8 Internet (Wi-Fi)

    8.1 The Landlord provides the Tenant with internet access (Wi-Fi) during the stay.
    Usage is at the sole responsibility and sole risk of the Tenant.

    8.2 The Tenant undertakes to use the internet access exclusively for legally
    permissible purposes. In particular, downloading, uploading, redistributing or
    otherwise making publicly available copyrighted works (e.g. films, music, software,
    games) without the corresponding rights, as well as accessing or distributing any
    other unlawful content, is strictly prohibited.

    8.3 Any legal violations committed via the internet access provided by the Landlord
    shall be the sole responsibility of the Tenant. The Tenant shall indemnify the
    Landlord against all third-party claims (in particular cease-and-desist costs,
    damages, attorney's fees, court costs and fines) arising in connection with any
    legal infringement committed by the Tenant or one of the Tenant's companions
    through the internet access.

    8.4 In the event of a cease-and-desist letter (Abmahnung) or other legal action by
    rights holders, law firms or authorities in connection with internet usage during
    the Tenant's stay, the Landlord expressly reserves the right to transmit the
    Tenant's personal data (name, address, period of stay, contact details) to the
    respective claimant or their lawyers, so that they may pursue their claims directly
    against the Tenant. The Tenant hereby expressly consents to such data transmission.


    § 9 Landlord's liability

    9.1 The Landlord is liable for damages resulting from injury to life, body or health
    caused by negligent breach of duty by the Landlord or by intentional or negligent
    breach of duty by a legal representative or vicarious agent.

    9.2 For other damages, the Landlord is liable only in cases of intent or gross
    negligence, or in case of breach of a material contractual obligation.

    9.3 As self check-in takes place without personal presence of the Landlord, the
    Landlord assumes no liability for:

    (a) personal belongings or valuables left in the apartment by the Tenant;

    (b) damages caused by improper use of the apartment or its furnishings by the
    Tenant or accompanying persons;

    (c) damages resulting from the Tenant's independent activities outside the
    apartment (e.g. city sightseeing, Black Forest excursions);

    (d) damage, theft or vandalism affecting the Tenant's vehicle on the outdoor
    parking space (see § 6.3).

    9.4 Liability of the Landlord for slight negligence in the breach of non-material
    contractual obligations is excluded.


    § 10 Tenant's liability

    10.1 The Tenant is liable for damages to the apartment, its furnishings and the
    common property caused intentionally or negligently during the stay.

    10.2 Damages must be notified to the Landlord without undue delay, at the latest at
    check-out, in writing (email is sufficient).


    § 11 Cancellation and withdrawal

    11.1 Cancellation conditions follow the tariff option selected at booking (e.g.
    flexible, non-refundable). For bookings via third-party platforms, their
    cancellation rules additionally apply.

    11.2 In case of no-show without prior cancellation, the full agreed price is due.


    § 12 Data protection

    Processing of personal data takes place in accordance with the privacy policy of
    the Landlord, available on rentapartment-freiburg.com.


    § 13 Final provisions

    13.1 German law applies, excluding the UN Convention on Contracts for the
    International Sale of Goods.

    13.2 Place of performance and exclusive place of jurisdiction for merchants is
    Freiburg im Breisgau.

    13.3 Should individual provisions of these GTC be wholly or partially invalid, this
    shall not affect the validity of the remaining provisions.
